Sasha specializes in environmentally-related public and planning law and is on the Attorney-General's "B" Panel of Junior Counsel and Panel Counsel for the Equality and Human Rights Commission. She has appeared at all levels up to the Supreme Court and has extensive experience of judicial review proceedings, statutory appeals and planning inquiries.  She is recommended as a leading junior by the Legal 500 2016 for Administrative & Public law, which states that "she has an excellent manner with clients that gives them confidence" and 2017  “She’s very bright and has a sound grasp of the finer detail” and by Chambers & Partners for environmental law including "she is excellent on her feet, and produces great written work" and "she is excellent at dealing with the political sensitivities of a case."  Sasha advises on a range of environmental public law matters including EIAs, protected species and habitats, waste and energy (including wind farms), challenges to government procurement of environmental infrastructure.  She also enjoys doing a wide range of marine work, including marine licensing, Harbour Orders, public rights of navigation, marine DCOs and fisheries regulation, including EU quota allocations, other fisheries regulatory matters, and she works internationally on environmental matters including appeals relating to the certification of voluntary sustainability standards.  Her clients include corporations, national Government, many local authorities and Parish Councils, NGOs, individuals, and regulators.

            Powell v Marine Management Organization [2017] EWHC 1491 (Admin), the leading case as to public rights of navigation and the proper interpretation of the marine licencing scheme

            Dunnett Investments Limited v SSCLG [2017] EWCA Civ 192, the definitive statement from the Court of Appeal about the words necessary to exclude permitted development rights for schemes

            R (Guernsey) v DEFRA [2016] EWHC 1847 (Admin), an important challenge by the States of Guernsey to the UK Government’s Fisheries Policies

            Greenpeace v DEFRA [2016] EWHC 55 (Admin); challenge brought by Greenpeace to the Secretary of State’s allocation of fishing rights under the EU Common Fisheries Policy;

            Johnson v DEFRA [2015] UKUT 0207 (AAC); the only Nitrates appeal to have been determined by the Upper Tribunal (where she was also successful in the 2016 remitted appeal to the FTT);

            Powell v Brighton Marina Company [2015] EWCA Civ 650, as to the scope of a Private Act of Parliament in commissioning a marina

            R (East Bergholt Parish Council) v Barbergh DC [2016]EWHC 3354 (Admin) about the proper approach to Neighborhood Plans when construing Core Strategies; a further challenge has been granted permission as to the proper approach by Planning Officers at committee to 5YHLS assessments

            C-71/14 East Sussex Council Sasha acted for Central Government, led by James Maurici QC in important cases about access to environmental information in property search charging.

 

Sasha has a very long-standing interest in environmental matters and has a Masters’ degree in sustainable development.  She has also been a Trustee and Director of Forum for the Future and has been a Trustee and Director of the United Kingdom Environmental Law Association as a member of the Governing Council.
