The CPA has championed reform in its sphere of interest, and is an active stakeholder for a host of consultations. It also hosts meetings bringing together parties to discuss mutual areas of interest.

The CPA National Committee propose an annual Law Reform lecture, open to members and non members alike, where experts can present their views on a subject of significant interest and concern, and with opportunities for contributions from the audience. It is intended that the Committee will subsequently produce a law reform paper. 

This year’s lecture chaired by Paul Singleton, Chairman of the CPA, focuses upon Temporary Possession Powers:

The power to take temporary possession of land for the construction of works is common in the case of railway schemes; the model clauses for Transport and Works Orders make such provision, and so does primary railway legislation. There are no express powers to take temporary possession of land in connection with highway and planning schemes. Significant practical problems arise for both scheme promoters and landowners where temporary possession is sought.

  • The legal effect and consequences of taking temporary possession of land subject to a tenancy.
  • The consequences of taking land permanently following exercise of temporary possession.
  • Proposals for legislative reform.
