Compulsory acquisition of land and rights is a powerful tool in the delivery of infrastructure, regeneration, urban renewal and housing. It is under the spotlight like never before. Many CPO eligible projects embrace the use of the powers due to the high levels of certainty they offer in enabling schemes to go forward with developers getting access to them through agreements with the local planning authority.  

There is increasing concern amongst many CPO practitioners about the proposals to reform compensation provisions to provide existing use value (EUV) in compensation - the current Levelling Up and Regeneration Bill and the Product Security and Telecommunications Infrastructure Act are the current examples where the State is seeking to revise market accepted valuation practices.  

The CPA continues to develop its affected parties focus. Claimants, through their mere presence (and not as a result of any action or inaction on their part), find themselves in a confusing and distressing process for an extended period where they are unclear as to the implications of that which is proposed nor how to mitigate the effects. The system can, and should, do so much more to support them. Securing the right compensation requires that acquiring authorities ask the right questions, make comprehensive enquiries and have all the relevant information in order to make a fair and full offer of compensation. Getting it right first time should be the mantra. Does a model claims form assist acquiring authorities? Elsewhere for practitioners, the RICS will deliver its updated Professional Statement and Red Book valuation demands in 2023.

2023 is an important year with the Government having commissioned the Law Commission to consolidate the law on CPO into a single Act. It’s been 20 years since Robert Carnwath, now The Rt. Hon. Lord Carnwath of Notting Hill, reported the need for consolidation and revision of CPO law and practice. Finally, this work will begin and the result will be a Draft Bill. We shall hear from the Commission on the project.
