Service Charge Heads Up: Where Is Best Practice?

In those days, best practice was defined by a non-compulsory service charge code, agreed upon and promoted in unison by a number of property bodies. Dealing with Informal Occupation
Over the last five or six years of economic and political uncertainty and turbulence, many landlords have tended to prioritise income over other aspects of property management. They may often have been prepared to accept occupiers of less than ideal quality, and to overlook the fact that terms of occupation have not been regularised. This is understandable in the short-term, but may lead to problems later on, as regards identifying what sums may be recoverable from the occupier, and ultimately the ability to recover possession. This module considers how occupation can be documented quickly and economically for short-term, low-value lettings, in the light of guidance from recent caselaw on the characteristics of licences to occupy and tenancies at will. The CPA's Annual Law Reform Lecture 2023
There is a groundswell of cross-party parliamentary support for such reforms, particularly associated with the drive to support the delivery of housing. The Government has consulted on amending the compensation provisions associated with the future prospect of planning permission and appropriate alternative development, where acquiring authorities could seek directions to cap the value paid to landowners at an amount at or above existing use value. We wait to see if the Government will introduce new clauses on this to the Levelling Up and Regeneration Bill. Whether it makes the Bill or not, there is political support for change, if not now, then next time. Meanwhile, the CPA has polled its members on the Government’s proposal and there is little support for anything that undermines market value.

The conclusions of the Fundamental Review of Business Rates (in England) - a review that began nearly two years ago - were published on Budget Day in October. The Final Report reaffirmed the importance of business rates and its continued central role in the tax system. The tax is therefore retained, but will be reformed. The reforms include: 3-year revaluations, which will involve new obligations and responsibilities for ratepayers and their professional advisers and further changes to the appeal system, the introduction of new reliefs - improvement relief and support for investment in green plant and machinery.
