Repurposing - Commercial and Residential In Conflict?

The planning system increasingly encourages flexibility and repurposing, but private property rights tend to be more restrictive. The law of private nuisance and restrictive covenants operates side-by-side with the planning system to control land use. It is not just freehold rights, but also rights arising under leases, which may constrain the freedom of both landlords and tenants. The move to repurposing is undeniable, nevertheless, and urban areas are increasingly mixed-use. Whether or not housing is provided in a mixed-use development, residential occupiers increasingly find themselves next to commercial uses, with potential for conflict, and this is underlined by the nuisance claims which make their way to court. In this on demand webinar we consider the legal issues raised, and potential means of resolution of the difficulties.

Opposing Lease Renewals - What, How, Why and When?

For the landlord wishing to get possession back at the expiry of a tenancy, the grounds and procedure for opposing renewal under the 1954 Act can look like an obstacle course. In fact, the cases lay down ways through which are comparatively straightforward, so the smart adviser can help the client to the right outcome effectively. There are also several practical tips which help to reduce the amount of compensation payable. Tenants, on the other hand, need to know the tactical levers which can help put them in the strongest negotiating position. The caselaw continues to develop, and this webinar considers recent cases as well as reviewing the grounds of opposition, tactics, timing and procedure.

Service Charge Heads Up: Where Is Best Practice?

CPT has been running training events on service charges since 1994. In those days, best practice was defined by a non-compulsory service charge code, agreed upon and promoted in unison by a number of property bodies. In 2019 it emerged as an RICS Professional Statement, which was mandatory and since it was accepted across the service charge industry, anyone – whether a RICS member or not – was going to be judged by whether they followed it. It had teeth in as much as anyone who was non-compliant had the threat of sanctions and public humiliation. Is it any wonder why it’s one of the top free downloads from the RICS website?

Rent Review and Lease Renewal: Session 1

The course will give an overview of the two procedures and look at recurrent issues such as whether the hypothetical lease should include a break option, what should be the assumed length of term, and how rent-free periods are taken into account in valuation. It will survey the dispute resolution options, with particular reference to the increasingly well-used PACT scheme, and consider what changes might usefully be made in the Law Commission’s current review of the 1954 Act. Landlords' Consents

In dealing with landlords’ consents the focus is usually on what is, or is not reasonable on the landlord’s part. This recording considers the up-to-date caselaw on this aspect. It is important to be aware of practical and procedural factors which have an influence on the outcome, whether or not a disputed application ends up in court. Going about things the wrong way can seriously undermine your negotiating position. The module examines relevant Protocols, consider what formal requirements might apply and the conduct of applications more widely. The types of consent addressed will include alienation, alterations and change of use.

    Dealing with Informal Occupation

Over the last five or six years of economic and political uncertainty and turbulence, many landlords have tended to prioritise income over other aspects of property management. They may often have been prepared to accept occupiers of less than ideal quality, and to overlook the fact that terms of occupation have not been regularised. This is understandable in the short-term, but may lead to problems later on, as regards identifying what sums may be recoverable from the occupier, and ultimately the ability to recover possession. This module considers how occupation can be documented quickly and economically for short-term, low-value lettings, in the light of guidance from recent caselaw on the characteristics of licences to occupy and tenancies at will. It will also consider strategies to untangle the knot when problems have arisen.

    Tenant Insolvency & Landlords’ Rights

There are many different kinds of insolvency procedure and while some are highly restrictive of the actions a landlord might wish to take, others are not. It is not enough to settle for the information that the tenant has ‘gone bust’ and simply wait to see what payment, if any, emerges. Landlords and their advisers need to be aware of the forms insolvency and pre-insolvency procedures may take, what options remain open and the effective routes to maximising payment of rent and other sums, or obtaining possession if required. This recording takes a practical approach to the issues raised by tenant insolvency.

The CPA's Annual Law Reform Lecture 2023

There is a groundswell of cross-party parliamentary support for such reforms, particularly associated with the drive to support the delivery of housing. The Government has consulted on amending the compensation provisions associated with the future prospect of planning permission and appropriate alternative development, where acquiring authorities could seek directions to cap the value paid to landowners at an amount at or above existing use value. We wait to see if the Government will introduce new clauses on this to the Levelling Up and Regeneration Bill. Whether it makes the Bill or not, there is political support for change, if not now, then next time. Meanwhile, the CPA has polled its members on the Government’s proposal and there is little support for anything that undermines market value.
