Preparing Challenges has become a part of all rating surveyors everyday working life but, as we enter the final year of the 2017 revaluation, producing Challenges is likely to intensify. In the April 2022 edition of Talking Heads we will examine what makes an effective Challenge, the content that must be included as well as pitfalls and what should be avoided and we conclude by looking at how to convert a Challenge into an appeal. The regular talking heads are joined by Dan Kolinsky QC, Lee Anderson of the Valuation Tribunal Service and Alison Gidman from the VOA. Topics under discussion will include:

  • The legislative framework and requirements for a challenge
  • Identification of key propositions
  • Evidence (kitchen sink or just the essentials)
  • Expert v Advocate
  • Reg 17 Evidence
  • The right to request a proposal
  • Effective Rebuttal
  • Golden Rules
  • How to weave rebuttal evidence into your proposal
  • Turning a challenge into an appeal
  • Appeals to VTE – evidence submissions and the New VTE rules and problems associated with them
  • The road ahead
