January's Discussion: Preparing for the Planning and Infrastructure Bill

The Ministry of Housing, Communities and Local Government (MHCLG) has launched a consultation on proposed compulsory purchase process and compensation reforms for England and Wales, in the shadow of the forthcoming Planning and Infrastructure Bill, expected in 2025. The consultation seeks views on technical reforms aimed at making the compulsory purchase process quicker, reducing costs, and changing some compensation rules. Key proposals in the consultation include:

  • Expanding the power to remove 'hope value' from compensation assessments for certain categories of land
  • Technical reforms to streamline the CPO process and reduce costs, such as allowing electronic service of notices and simplifying newspaper notices
  • Allowing inspectors to make decisions on CPO confirmations with directions to remove hope value
  • Rectifying errors in CPOs 
  • Changing some of the rules around temporary possession powers 
  • Changes to Loss Payments

These proposals are part of the government's commitment to further reform compulsory purchase compensation rules to improve land assembly, speed up site delivery, and deliver housing and other benefits in the public interest.

This CPO Talking Heads session will provide an opportunity to analyse these proposals in depth and discuss their potential implications for the compulsory purchase process. This will be a helpful discussion in advance of the consultation closing on 13 February 2025.
